General rules of the “CHILDREN OF TIME” association regarding the order and conditions for the effectuation of mediation in international adoptions.
General Conditions
“CHILDREN OF TIME” insists on the observation of the international acts and the law, on the recognition of the Bulgarian and foreign bodies and institutions, as well as on the respect in its relations with the other accredited organizations. “CHILDREN OF TIME” has the right and is obliged to effect the following factual and legal activities before the Ministry of Justice of the Republic of Bulgaria:
1.Presents to the Ministry of Justice the request for adoption and the documents of the adoptive parent, as well as any other information about the adoptive parent, requisite for the protection of the interests of the child; 2. Presents to the Ministry of Justice the request for adoption together with the whole file; 3. Notifies the Ministry of Justice regarding the consent or dissent for the adoption of the offered child, expressed by the adoptive parent; 4. Presents to the Ministry of Justice a certified transcript of the court resolution for admission of the adoption in a 7-day term from its coming into effect, as well as any other information and all acts regarding circumstances related to the child; 5. Presents every 6 months to the Ministry of Justice a report for the status of the child up to 2 years after its adoption; 6. Mediates in the issuance of a permit allowing the child to leave the country of origin and to enter the receiving country, as well as of a permit for a permanent sojourn of the child in the receiving country;
“CHILDREN OF TIME” has the right and is also obligated to effect the following legal and factual activities according to the written contract with its clients – candidates for adoptive parents:
1. Presents to the adoptive parent detailed information for the rights and obligations during the adoption and for the legal consequences of the full adoption in conformity with the operative legislations in the countries whose citizens are the child to be adopted and the adoptive parent, as well as in the country of residence of the adoptive parent; 2. Acquaints the clients before the conclusion of the contract with the information described in detail in Art. 55, Par. 1 of Regulation No. 3 of 03.09.20003 of the Ministry of Justice. 3. Prepares and submits to the Ministry of Justice the request of the adoptive parent and encloses thereto all documents requisite according to the law in their original form and in Bulgarian translation with the respective verifications; 4. . Mediates upon the establishment of contact between the specified adoptive parent and the child to be adopted, and presents to the adoptive parent the report prepared by the Ministry of Justice regarding the personal data of the child to be adopted, its health status, its social status, a photograph, and, if requisite, video recordings and other materials about the child; 5. Notifies the adoptive parent about the consent of the minister of justice according to Art. 136, Par. 1 of the Family Code; 6. ÎEnsures representation of the adoptive parent before the court; 7. Ensures the safety and the suitable conditions for the transportation of the child, and, if such is the decision of the adoptive parents, effectuates the transportation or ensures the accompanying of the child; 8. Ensures to Bulgarian citizens who wish to adopt a child – foreign citizen, the information about the specific child presented by the respective body or organization; 9. Undertakes activities regarding the return of the child in the country of origin, in case the resolution of the Bulgarian court is not acknowledged in the receiving country up to one year after its coming into effect and follows the status of the child during this period; 10. Ensures accessible and comfortable premises for the clients, which create conditions for the preservation of the secret of the clients’ identity, of the stored and incoming information.
Upon effectuation of its activity, “CHILDREN OF TIME” observes the requisite terms and stages of the adoption process and undertakes the requisite activities with due care.
