1. To conform to the adoption requirements according to the legislation of their home country. If they reside permanently in another country – to conform to the requirements of the law of the country of their permanent residence, if it differs from the legislation of their home country. 2. Not to suffer from grave chronic and infectious disease, endangering their life; 3. Not to be deprived or to have been deprived of parental rights; 4. Not to have any convictions; 5. To have concluded a civil marriage, when they wish to adopt together; 6. To present all essential documents, required according to the Bulgarian legislation.
Criteria regarding the reviewing of requests of foreign candidates for adoptive parents entered into the register according to Art. 136à, Par. 2, i. 7, l. “b”
The Hague Convention of May 29, 1993 on Protection of Children and Cooperation in Respect of Inter-country Adoption orders as a basic and leading principle the guarantee with the best protection of the highest interest of the child and observation of its basic rights. Taking this under consideration and according to Art. 9, Par. 1 of Regulation No. 3, the leading one is the register of the children who can be adopted under the conditions of full adoption according to Art.136à, Par. 2, i. 7, l.”à” of the Family Code, and more particularly, the specific child with a serial No. of entry therein.
The following criteria are considered together and separately due to their mutual commitment, when reviewing the requests of foreign adoptive parents entered into the register:
-do the characteristics of the child, contained in the certificate for suitability of the adoptive parent correspond to the characteristics of the specific child for whom a suitable adoptive parent is wanted; -do the recommendations and the conclusion of the specialists who have prepared the report from the social study regarding the suitability of the adoptive parent for the adoption of a child with specific characteristics correspond to the characteristics of the specific child, for which a suitable adoptive parent is wanted; -to what extent the adoptive parent has declared willingness to accept a child with characteristics and needs corresponding or similar to the ones of the specific child for which a suitable adoptive parent is wanted; -to what extent the adoptive parent is capable of meeting and adequately responding to the special needs of the child (if any) and the possibility for the improvement of his general health condition; -does the adoptive parent have those characteristics, which could, as effectively as possible, correspond to the specific needs of the child; age of the adoptive parent; -social status of the adoptive parent (education, profession, general economic status, living conditions, etc.); -family status of the adoptive parent; -internal family climate and relations, past parental experience or experience in looking after children (if any);
