INSTRUCTIONS TO THE BULGARIAN ACCREDITED ORGANIZATIONS IN RELATION TO THE PROCEDURE REGARDING THE EFFECTUATION OF CONTACT BETWEEN A CHILD ENTERED INTO THE REGISTER ACCORDING TO ART. 136А, PAR. 2, I.7, L. “А” OF THE FAMILY CODE AND THE DETERMINED SUITABLE ADOPTIVE PARENT – FOREIGN CITIZEN

1.         The Ministry of Justice, in its quality of a central body according to the Hague Convention of 29.05.1993 and with regard to its control authorities, announces that it shall notify in writing the heads of the specialized institutions in the country regarding the period during which the establishment of contact is expected between a child located in the respective institution and the determined suitable adoptive parent – foreign citizen, as well as regarding which persons from the Bulgarian accredited organization engaged in the specific procedure and in what quality will accompany the adoptive parent.

2.         For this purpose, in a reasonable term before the effectuation of contact (one week term is recommended), the Ministry of Justice shall receive by the Bulgarian accredited organization engaged in the specific procedure a written notification concerning the stipulated period for the establishment of contact and also concerning the fact which persons from the organization and in what quality shall accompany the adoptive parent and shall partake during the contact.

3.         Upon the effectuation of contact between a child and the determined suitable adoptive parent – foreign citizen, persons on the part of the accredited organization that have not been involved in it according to the legally established order and have not been declared in the Ministry of Justice cannot take participation in said effectuation.

4.         After the effectuation of contact, the Ministry of Justice shall require from the head of the respective specialized institution a certificate regarding the period during which the contact was effectuated according to Art. 12 of Regulation No. 3/2003, the persons between whom said contact has been effectuated - child and an adoptive parent and which persons and in what quality on the part of the organization have attended and have accompanied the adoptive parent during the contact. Instructions regarding the indicated certificate shall be made on the part of the Ministry of Justice to the head of the respective specialized institution with the notification regarding the forthcoming contact (see item 1). Together with the notification, a reminder shall be effected that persons who are not indicated herein should not be admitted in the specialized institution in relation to the effectuation of contact.
